ASPCA Officers found the rooster’s beheaded body on the second floor fire escape of his apartment.  A neighbor had complained last month about a dead rooster near his apartment.

Rodriguez is charged with one count of animal cruelty and could face up to a year in prison and/or a fine of $1,000 if convicted.  It is illegal to possess a live rooster in New York City
