Horak was charged with 4 counts of violating animal health regulations.  2 of the counts are for failing to provide humane treatment by improperly moving a downed animal and failing to euthanize it in a timely manner, 1 count of failing to provide the needed equipment for handling, moving the animal and 1 count of failing to euthanize the downed animal at the close of the sale or place her in the care of a licensed veterinarian.

The charges come after an investigation into reported inhumane treatment of a non-ambulatory cow at the auction on April 22-23.

Horak has 15 days to respond to the charges and could face a hearing before an administrative judge.

Update 6/12/08:

Horak, owner of the Westminister Livestock Auction Market will settle charges filed by the state Agriculture Department.

Horak of Hanover, PA said he won't admit animal cruelty but said he will acknowledge he should have immediately shot a "downer" cow, as the animal was too weak to stand, instead of leaving he ailing animal outside overnight.

As a result of the plea agreement, the auction market will be placed on probation for 9 months.
