31 Seized Pit Pulls suspected of being used in dogfights

Many of the Pit Bulls seized from 4901 Hoover Avenue home in Dayton on Monday, July 24th, have been deemed as not adoptable by the Montgomery County Animal Resource Center.

Many of the dogs have visible bite marks, scars, open sores and skin conditions on their necks and forelimbs.  They appear to be underweight and some still cower in their cages.  Heavy metal bolt chains were removed from several dogs when they were rescued.  There is a level of aggression among the dogs that requires the center to house them separately, thus making them ineligible for adoption.

The dogs are undergoing a series of behavioral evaluations and health examinations as they are being treated for injuries and illness.

On 8/11/06, Denby, who resides at 723 Mia Avenue, requested a temporary restraining order against the Dayton Police Department and the Montgomery County Animal Resource Center from denying him access to photograph and conduct independent assessments of the dogs as well as discontinuation of kennel fees, pending the outcome of the Dayton Police Department’s investigation according to court records – case # 06-6160.

On 8/16/06, the court ordered that The Dayton PD and Montgomery County Animal Resource Center must permit Denby with a licensed veterinarian and his attorney, the right to personally observe and take photographs (without flash) or videotape (only his 31 dogs) and to allow Denby to conduct a veterinarian evaluation up to 9/6/06.

Judge Michael Hall issued the civil court restraining order on Denby’s affidavit that he would suffer irreparable injury, loss and damage and that without photos and independent evaluations, he could not adequately defend himself against any potential criminal charges.  He further argued that time was of the essence, since any alleged injuries would disappear and heal and would not allow him to prove such injuries were not the result of an misconduct on his part.  Denby’s affidavit further argued that he not be charged $7.00 per dog per day for the continued costs incurred against him for kennel fees as no criminal charges have been filed.
